Many founders in India’s AI space fear the rule may cast too wide a net. They worry even creative or harmless uses of AI — like marketing visuals or blog assistance — could be over-regulated.
“This may lead to over-compliance and hurt creativity,” says a founder of a Bengaluru-based GenAI startup. “Not every AI-assisted post spreads misinformation.”
The biggest challenge lies in defining what counts as ‘AI-generated’. Does a blog polished with Grammarly’s AI count? What about a ChatGPT summary? The ambiguity could create confusion for small creators and businesses.
Who Should Carry the Responsibility?
Experts argue that LLM developers and AI platform owners — like OpenAI, Google, or Anthropic — should bear most of the burden.
They have the tools to embed watermarks or metadata that identify AI-generated content automatically. That would keep small creators from worrying about compliance with every post.
“Accountability should start with the model creators,” says one policy researcher. “They built the systems — they can build transparency into them.”
